Terms of Service

These terms apply to your use of APEX. Please read them, particularly the sections on subscriptions, free trials, automatic renewal and cancellation.
Trials are available only for eligible first subscriptions. Returning subscriptions may bill immediately.
Acceptance of these terms
By creating an APEX account or using the service, you agree to these terms. If you do not agree to them, do not use APEX.
Eligibility and your account
You must be at least 16 years old to use APEX. You are responsible for the accuracy of the email address on your account, for keeping your password confidential, and for activity that takes place under your account.
If you believe someone else has gained access to your account, contact support@apexhabit.app so we can help you secure it.
What APEX is
APEX is a habit-tracking application. After you create an account you answer eight onboarding questions and receive a generated personalized starting habit plan of three to seven habits. From there you track daily habit completions, edit habit names and schedules, archive habits you no longer want to track, and view your progress and consistency.
Subscriptions and pricing
Access to APEX is sold on a subscription. The plans are:
- Weekly — $3.99 per week. This plan has no free trial and bills weekly from the moment of purchase.
- Monthly — $14.99 per month, with a 3-day free trial.
- Yearly — $49.99 per year, with a 3-day free trial.
Prices are listed in US dollars and may be shown to you in your local currency. Applicable taxes are handled at checkout.
Free trials
The Monthly plan includes a 3-day free trial. If you do not cancel before the trial ends, the subscription continues and you are charged $14.99 per month.
The Yearly plan includes a 3-day free trial. If you do not cancel before the trial ends, the subscription continues and you are charged $49.99 per year.
The Weekly plan does not include a free trial and bills weekly from purchase.
Automatic renewal
Subscriptions renew automatically at the end of each billing period — weekly, monthly or yearly according to the plan you chose — at the then-current price for that plan, unless you cancel before the period ends. Cancelling stops future renewals; it does not by itself refund a payment already taken. Refunds are covered by our Refund Policy.
How to cancel
Your subscription is managed through Paddle, which processes the payment as Merchant of Record. You can cancel in either of these ways:
- Use the receipt or subscription-management link that Paddle emails you after purchase, or contact Paddle Buyer Support at https://www.paddle.com/help/buyers.
- Email APEX support at support@apexhabit.app from the address on your account, and we will help you cancel.
To avoid being charged when a free trial ends, cancel before the end of the trial period. See our Support page for more detail.
Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Paddle acts as the Merchant of Record for APEX purchases. Paddle handles the payment transaction, billing and the applicable payment-related processes, including tax. APEX does not receive or store your card details.
Your purchase is therefore also subject to Paddle's own buyer terms, and payment-related questions can be taken directly to Paddle Buyer Support at https://www.paddle.com/help/buyers.
Acceptable use
You agree not to:
- Use APEX for any unlawful purpose, or in a way that breaks the law where you live.
- Share, resell or transfer your account or your access to APEX.
- Attempt to gain unauthorised access to the service, other accounts, or the systems behind them.
- Interfere with or disrupt the service, including by overloading, probing or scraping it.
- Copy, reverse engineer, or create derivative works from the service, except where the law expressly allows it.
- Upload content into habit names or other fields that is unlawful, abusive, or infringes the rights of others.
Intellectual property
APEX, including its software, design, text and branding, belongs to us and is protected by intellectual property law. These terms give you a personal, non-exclusive, non-transferable right to use APEX while your subscription is active, and nothing more.
The content you enter — your habit names, schedules and completion history — remains yours. You grant us only the permission needed to store and display it back to you as part of running the service.
Changes to the service and availability
We may add, change or remove features, and we may change how APEX works, in order to improve it. We aim to keep the service available, but we do not guarantee that it will be uninterrupted or error-free; it may be unavailable during maintenance or because of problems with the providers the service depends on.
If we discontinue the service entirely, we will give reasonable notice where we can and handle any active subscriptions fairly.
No guaranteed outcome, and not health advice
APEX is a habit-tracking tool. It helps you record and review what you do. It does not guarantee any particular outcome, result, improvement or change in your life, health, productivity or behaviour, and results differ from person to person.
APEX does not provide medical, psychological, mental health, nutritional or other professional health advice, and nothing in the app — including any habit in a generated plan — should be treated as such. It is not a substitute for consulting a qualified professional. If you have a health concern, speak to a qualified professional, and do not delay seeking advice because of something you read in APEX.
The service is otherwise provided on an “as is” and “as available” basis, without warranties of any kind except those that cannot be excluded by law.
Limitation of liability
To the fullest extent permitted by law, APEX is not liable for indirect, incidental, special or consequential losses, or for lost profits, lost opportunities or lost data arising out of your use of the service.
To the fullest extent permitted by law, our total liability to you for any claim connected with the service is limited to the amount you paid for APEX in the twelve months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your mandatory statutory rights are not affected.
Suspension and termination
You may stop using APEX at any time and may ask us to delete your account, as described in our Privacy Policy.
We may suspend or terminate access to an account that breaches these terms, that is being used unlawfully, or where suspension is necessary to protect the service or other users. Where it is reasonable to do so, we will tell you why.
Changes to these terms
We may update these terms as APEX changes. When we do, we will update the date at the top of this page. Continuing to use APEX after an update means you accept the updated terms; if you do not accept them, stop using the service and cancel your subscription.
Your consumer rights
Nothing in these terms takes away the mandatory consumer protections that apply in the country where you live — those rights continue to apply to you in full, and you keep the right to bring proceedings in your local courts where the law gives you that right.
